Familiarization With the Case File Before a Decision is Made
The Administrative Procedure Code allows you to comment on the case file before a decision on your application is made1. This does not apply to applications that have been fully granted, cases where the procedure has been terminated by a resolution on discontinuation or suspension, or applications in which the party has waived the right to comment on the case file.
You will be notified in writing about the possibility to familiarize yourself with the case file. The notice will also specify the appointment date or the deadline by which you can visit the office to familiarize yourself with the file.
Is familiarization with the case file mandatory?
No. Familiarization with the case file is an option, not an obligation. It is up to you whether you wish to exercise this right. However, using this right is recommended, as it is the last opportunity during the procedure before a decision is issued, for example, to submit required documents or provide comments on the case file.
How can you book an appointment for familiarization?
If you are not invited to attend on a specific date, you can book an appointment via Clients Centre.
I want to familiarize myself with the case file, but I am unable to arrive within the set period.
In this case, you can submit a request to extend the period.
How does familiarization with the case file work?
During the familiarization, the case file will be presented to you at the office. You have the opportunity to study the file and, if needed, make copies of documents. After familiarization, you will be asked whether you wish to set a time period for submitting additional documents or for providing comments before the decision is issued. These documents or comments do not need to be submitted immediately on site. If you do not understand the documents, you may contact the Integration centre or other NGOs.
