Suspension of Administrative Procedure
If, during the administrative procedure, facts are established that constitute grounds for suspension, the Ministry of the Interior suspends the administrative procedure by a resolution.
The grounds for suspension are regulated in accordance with the Administrative Procedure Code1. For residence permit procedures these include in particular:
- correction of errors in the application,
- ongoing procedures on a preliminary issue,
- at the requsest of the applicant.
- If you request suspension of the administrative procedure, you must state the reason for which you seek the suspension. Without a stated reason, your request will not be granted.
Once the obstacles leading to the suspension have been removed, the Ministry will send you a letter informing you that the administrative procedure will proceed.
If the resolution on suspension sets a time period for a specific act, the administrative authority may, upon your request, extend that time period as appropriate.
During the suspension, only acts aimed at removing the reason for suspension are carried out.
If you have submitted an application, the processing period for issuing a decision stops on the day the reason for suspension arose and does not end earlier than 15 days after the suspension has ended.
