Binding Opinion of the Labour Office
While processing applications for extension of Employee Card validity, the Ministry of the Interior requires a so-called Binding Opinion of the Labour Office, which is issued by regional offices or Prague office, depending on the location of employment. With regards to the current situation of the labour market in respective region, relevant office evaluates whether further employment of the particular foreigner is permittable and issues appropriate Binding Opinion.
An approving Binding Opinion is required for the extension of an employment card. If a negative Binding Opinion is issued, the application may be rejected.
The Labour Office issues a Binding Opinion within 15 days of receiving the inquiry from the Ministry of the Interior. If no Binding Opinion is issued within the said processing period, it is deemed that the Labour Office evaluated the employment of the particular foreigner is permittable.
