Repeated offences as a new reason for cancelling certain residence permits

With the amendment to the Act on the Residence of Foreigners, effective from January 1, 2026, repeated commission of offences will newly be a reason for not granting, revoking or not extending a long-term visa or residence permit.

A long-term visa or long-term residence permit may newly, as of January 1, 2026, be not granted, revoked or not extended if, within a 12-month period, the foreigner repeatedly commits an offence three times in succession that is recorded in the Register of Offences under the Act on Certain Offences1.

Only offences recorded in the Register of Offences (which forms part of the Criminal Register) are taken into account. More detailed information on which offences are recorded can be found on the website of the Ministry of Justice.

This statutory provision applies to all holders of long-term visas and long-term residence permits, including Employee Cards, Blue Cards and the special long-term residence permit. By contrast, the provision does not apply to holders of permanent residence permits, temporary residence permits of a family member of an EU citizen, registration certificates or holders of temporary protection.
